The conditions that govern your use of smarterclaims, operated by Lexity.ai AG.
When we say “Lexity” we mean Lexity.ai AG, a company registered in Switzerland with company registration number UID: CHE-191.846.557, having its registered address at Hergiswil, NW, Switzerland; and when we say “our website” or “smarterclaims” we mean the website with the URL smarterclaims.co.uk. When we say “our”, “we” or “us” we mean Lexity and smarterclaims.
smarterclaims is maintained and operated by Lexity.
1Our service and its restrictions.
smarterclaims is a self-help digital software tool, designed to help you understand what your insurance products cover, what to do if you have an insurance claim under one of them, and what to do if you have an insurance claim wholly or partly refused by your insurer (“our service”). By using our service you agree to be bound by these terms and conditions.
We strive to make our service accessible to as many people as possible. To deliver our service to you at a cost-effective price, we use standard-form documents that we have prepared for the technology we have designed (which includes Artificial Intelligence) to review against the important but limited amounts of information you give us. This means that, although the information we supply to you in providing our service is accurate, it is not personally tailored to you or your circumstances in the way it would be if we were taking full and complete instructions and charging you on this basis. In recognition of these factors, you agree that by using our service:
- Our liability to you (or anyone else you are helping) for using our service (or any part of it) is limited to the total amount you have paid to us for using our service;
- Other than in the case where you have paid a fee for our service, no contract is formed between you and Lexity and/or smarterclaims;
- We are not giving you advice and our service is limited to providing you with information by way of general comment only;
- We do not guarantee that our service covers every type of insurance policy, insurance claim or insurance claim refusal, or that it will identify all relevant factors;
- We do not guarantee that our service will result in a favourable outcome in you making any insurance claim or in resolving any insurance claim refusal or dispute;
- We do not act as your representative, agent, or intermediary. We will not contact your insurance provider, negotiate payouts, or manage your dispute;
- You understand that our service is a tech-driven solution where the content you receive is driven by the quality, accuracy and volume of the information you upload to our website. You understand that, although our underlying content has been prepared by a human, the analysis, composition and delivery of what we provide to you when using our service is determined by Artificial Intelligence without any human involvement by us;
- You assume 100% responsibility for reviewing the accuracy of the information we provide to you and using it as you see fit;
- We are not a law firm, so we are not regulated by the Solicitors Regulation Authority (SRA), and we are not a claims management company or an insurance intermediary, so we are not regulated by the Financial Conduct Authority (FCA). We are a technology information service.
2Our intellectual property.
We own or license all intellectual property on our website and all works displayed on it, including any output generated in providing our service. We grant you a licence to use this output and these works, limited to your own personal use for the purpose of reviewing your own insurance policies, making an insurance claim under one of your own insurance policies, and/or trying to resolve a coverage dispute under one of your own insurance policies.
3Payments.
All transaction fees displayed on our website represent the total cost payable by you for the insurance-claims-refusal part of our service. All other parts of our service are free. There are no hidden fees added at checkout. All payments are securely processed by our third-party infrastructure provider, Stripe. We do not collect or store your payment card details.
4Our 14-day money-back guarantee.
The provision of our paid service involves the immediate supply of digital content when you explicitly request immediate performance of our contract with you at the point of payment. Upon the supply of this content to you our service is completed. This means that any statutory cooling-off period that you are entitled to will not apply once we have supplied this digital content to you. In recognition of this, we offer a voluntary, comprehensive 14-day money-back guarantee. If you are unsatisfied with any part of our service that you have paid for and you contact our support team at [email protected] to request a refund within 14 calendar days of payment, we will refund that payment in full. Once we have refunded your payment, your licence to use any of the content that we have sent to you in relation to that refund is revoked.
5Law and jurisdiction.
These terms and conditions, your use of our website and any digital content relating to our service are subject to and shall be governed by the laws of England and Wales, and shall be subject to the exclusive jurisdiction of the English courts.
