Travel insurance claim denied?

You bought it for exactly this.

Travel refusals lean on pre-existing conditions, exclusions you were never walked through, and evidence nobody told you to collect. The wording is not the last word — and Which? has already told the regulator as much.

“Your claim relates to a pre-existing medical condition which was not declared when the policy was purchased.”“You failed to take reasonable care to safeguard your property, as required by the policy.”“You did not notify us of the incident within the timescale set out in your policy.”“You failed to disclose a material fact. We have therefore avoided your policy from inception and returned your premium.”

Based on our statistics, 95% of claim refusals get approved just by sending a simple letter following the smarterclaims framework.

Questions

What you might be wondering.

Why do travel insurance claims get denied?

The most common reasons are an undeclared pre-existing medical condition, an exclusion in the wording that was not obvious at the point of sale, missing documentation, delays in notifying the insurer, and disputes about whether the reason for cancellation was actually covered.

Travel policies are also sold fast and cheap, often as an add-on, which means a lot of people have never read the terms being used to refuse them.

My insurer says I had a pre-existing condition. Can they refuse?

Only if the position stands up. For consumer policies the question is whether you took reasonable care not to misrepresent when answering the questions you were actually asked — not whether you volunteered your full medical history.

If the screening questions were vague, or the condition was unrelated to what you claimed for, or an honest mistake is being treated as deliberate, there is something to argue.

Is it worth complaining about a small travel claim?

It costs nothing to complain, and the Financial Ombudsman is free. Insurers know that most people will not bother over a few hundred pounds, which is part of why refusals on small claims are worth testing.

A well-argued letter changes the economics of ignoring you.

What did the Which? super-complaint say about travel insurance?

In 2025 Which? made a super-complaint to the FCA covering home and travel insurance, arguing that a number of leading insurers were not following the rules meant to protect consumers, and that small print was unfair and lacked transparency.

That is a useful piece of context: if the terms being used against you seem unclear, you are not imagining it, and the regulator has been told so.

Is this legal advice?

No. smarterclaims publishes legal information and writes letters you can send yourself — like a digital version of a published legal guide. We are not a law firm and we do not give advice.

If your case needs professional representation, we will tell you, and we can introduce you to the right people if you ask us to.

What does it cost, and do I pay before I see anything?

Checking whether you have a case is free. You see the analysis and the arguments before you pay anything.

The rebuttal letter is £49.99. It comes with an explanation of where you stand and a step-by-step plan.

There is a no-questions-asked money-back guarantee. If the pack is not useful, tell us within 14 days and we refund you in full.

Will complaining make my insurer harder to deal with?

It should not, and firms are required to handle complaints fairly. Insurers deal with complaints as routine business — a well-argued letter tends to be taken more seriously than an angry phone call, not less.
